Question:

Responsible for utilities?

We moved out 1 month before our lease was up (but paid all rent money due on time for the duration of the lease). Our landlord came and wanted to do repairs/upgrades on the house after we had vacated but before the 1 year lease was up. Was that our responsibility? Thanks.

  1. When you moved, you should have informed the utility company and had the account closed.  If you did not do that, you are liable for all of the utility bills until you do.  Once you pay the bills, you can try to get your landlord to reimburse you or take him to small claims court.

  2. You notify the utilities that "Effective June 30 we are no longer living in this apartment and will not be responsible for the utilities, please remove our names. Thank you.

  3. Utilities are done when you move out, even if the lease was terminated early. If the reason you left is because he asked you to in order to do repairs that is known as a constructive eviction, in such case you are not even required to pay the final month's rent (if he wanted you to leave so he could do work to it, but if he just decided to do the work because you had left then you do have to pay the rent for the month that you didn't stay).

As for the utilities your last day to pay was the day you left.

  4. You didn't state who's name the utilities where in when you lived there. if they where in your name you should have called for a final reading when you left.
