Restaurant customer's Dispute?

A group of 5 customers refused to pay their bill after complaining their one fish contained bones. We are dealing with fresh fish and of course, it may contain bones. 1 out of 5 meals was not fish dish at all. They finished hlaf of their meals and walked out without paying a penny. If I make civil claim, how much chance I will win? Is there any legal adviser out there can give me some professional advice or even links of court judgment?

  2. They could have been arrested for walking out on their bill. It's the same as stealing.

  3. Is that the only dish they had? Had they had starters? They can refuse to pay for the meal as they didnt finish it but if they had anything else like drinks, starters etc. they have to pay for it, its stealing otherwise, they should have been stopped and arrested.

  4. You should go to the small claims court. Their reason for not paying is a nonsense. I would say that you will win payment and costs. I am not a lawyer, but have read of similar cases. They are having a laugh! Don't let them get away with it or they will do it again and again.

  5. if they ordered the meal and left without paying it is wrong if they felt the meal was poor and not up to the standard expected they should have payed what thy thought it was worth payed nothing so take them to a small clam court or call the police

  7. It is called Defauding an Innkeeper and is against the law. You cannot be sued for bones in a fish either since it is covered under law as a natural happening.

  8. In the UK you must pay for the food and drinks consumed. If you know who these people are you should make an application to the Small Claims Court, this will be the cheapest route open to you. Call your local Citizens Advise Bureau, if you manage to get to talk to someone they will be very helpful.

  10. If you are in the UK you have an excellent chance.

    They should have paid for everything except the one fish, which incidentally if you took them to court they'd loose that as well, fish do have bones.

    I'd go via the small claims courts however I would have called the police at the time, although a civil case the police would have noted all their details and attitudes etc.
