Restraining Order?

Hi,

I am looking at the possibility of placing a restraining order on someone who has recently assaulted me and two of my friends. The police have charged him with the following crimes:

- Grievous bodily harm

- Assault occasioning actual bodily harm

- Aggravated Assault

He lives near to my home and although he has been released on bail, continues to intimidate me. He regularly walks by my house with all his associates, looks in the window and makes rude gestures in addition to gun gestures.

The day after he got out on bail my cat turned up with injuries to its tail and leg (The leg and tail have had to be amputated). I can’t prove that it was him, but I know that it was.

I really feel afraid for my family’s safety and would appreciate any advice on how to deal with the matter. (Specifically if I have grounds for a restraining order and how I go about having it put in place).

  1. Get a restraining order first thing tomorrow morning  you can also put a video camera in the  window one with time & date stamp  so you can catch him on video if he looks in your window they can charge him with peeping  & trespassing  if you catch the gun gestures  that is a charge of intimidation by threat   he can be arrested on these charges  the more charges & violations  the higher his  bail  & the less the likely hood he will get out  depending on your state a restraining order will cost you  $50.00 to $75.00 & will stay in effect for 60 to 90 days


  2. Yes, you can file.  Go to the police station and ask them how to go about putting the RO in place.  They can offer you a temporary one until the issue can be taken to court for a more permanent one.  Make sure that they know that you fear the life of yourself and your family members.

  3. Restraining order, NOW! Don't wait. You have all legal rights for one, especially after reading all you posted here, I cannot understand why the cops did not suggest one in the first place. This person is an obvious threat to society, and never should have been let out.

  4. yes you absolutely have grounds for a RO.

    Just keep in mind he will still be able to be in the area, same groceries stores as you etc, he lives there too. But it will protect you from him looking your windows, threatening you etc...

    and remember RO's go both ways. so that means you must avoid him (I'm sure u do anyway) just as he must avoid you.
