Question:

Restraining order or Personal protection order?

What is the difference and which is easier to get. My friend was assaulted by 2 people and wants to make sure it never happens again.

Charges were filed and a police report was made, against the 2 people. Both have prior assault charges against them.

  1. Restraining orders are easier to get, but they do not work.  Get your own protection.


  2. Get PERSONAL PROTECTION. If you can't depend on self, who can you depend on in that moment of life or death.

  3. They are essentially the same thing with different names and most likely require the same level of proof to get.

    My advice would be for your friend to get a lawyer and once they are arrested have a conditional of their bail, provided your area allows it, that they have no contact with your friend. This would most likely add a bit more 'teeth' to the order than if he went to get a restraining order / protection order and if they violated the order then potentially they could have their bail removed which would then mean they would be in jail until their trial.

  4. A restraining order is often a false sense of security.The suspects have to be caught in the act, by the police ,to be in violation of it.They are often just more careful about it in the future.I'm just not convinced of there effectiveness.The best way to protect one's self against the assailants is to have friends around.In other words,stick together.You know,power in numbers.

    I'm not sure what a personal protection order is.

I  respectfully disagree with other posters.  It is true that people  violate restraining orders, but when it happens the penalties are severe and include mandatory jail time.  I had a restraining order against someone  and when he violated it he went to jail for 60 day and when he got out of jail he had to wear a gps device so that the govt could see that he was staying away from me.  This was before his trial for assaulting me. If I hadn't filed the restraining order I wouldn't have had this protection. The police where I live took my safety very seriously.
