Long story short, a friend of mine was getting beat on by her husband, and I was attempting to drive her to the Police station, her husband went berserk, and rammed his car into the truck. lawsuits were filed, and needless to say, she's also no longer a friend. I had to file a restraining order against them both, including 3rd party contact, and it was granted. She just recently found me on myspace, and wants to talk, Im not talking to her, as fear of loosing the restraining order and well she's insane. Is it valid up here in Alaska, as in NY? It's good till 2010. If it's still good, can I contact the DA office in NY and let them know that Crazy is tryin to get back in my life again? I dont want to cancel it cuz we are heading back to ny. we just came home to AK while hubby is deployed.

  1. The order is enforceable in the jurisdiction it was issued in - the State of Alaska.   Now, I am an Illinois LEO and we find this situation from time to time and when someone moves here from another state with your situation, they go before a court in Illinois with the order, and the court reissues the order from the local court.  Your problem is that she is in NY while your in Alaska.  NY will not arrest her in that state - the offense and jurisdiction lies in Alaska - and I don't think your States Attorney wants to bring her there for trial - this is what I would do.

Make a report and sign a criminal complaint and a warrant will be issued for her arrest - even though it is only in serviceable in Alaska, it will still serve two purposes.  1) if she ever comes to the state - she will get arrested. 2) it will allow you to extend the order for a longer period.  You win.

  2. Contact the police who will inform you of your rights.Do not make or engage in any contact with someone you have a restraining order against as you are breaking the law by doing this as is the other party/person.
