Retroactive child support?

My son is now 19. The father started to pay $150 a month when my son was 9, Can I recover any support for the first 9 years he did not pay? There is no court order, he just started paying me.

  1. You would need a court order to legally force him to pay retroactively.


  2. without a court order there is not much you or your son can do. Because you need proof of how much is the amount previously agreed between both parties- you and your husband- to pay for child support.

    Without that is your word against him. i know because it happened to me by the 1990 when i separated from my ex.

    After the divorce i was lucky i got that settled.  

  3. Sorry but you can't wait that long to sue.  You have approximately 1 year to get your lawsuit underway..........if you wait several years......you better have a d**n good reason (like being paralyzed in the hospital, etc)........

    If you wait that long, you give up the right to sue.

  4. yes you can but since hes 19 you may not be able to now which is unfair to you and your son an there is an orgaization (sorry i dont know the name if it try to google it ) its helps woman recover the child support they deserve good luck ! do you think his father would do the right thing and pay it to you with out leagle action? this is his child and its not fair for him to get away with out child support i hope i helped some good luck (i dont think his age would be an issue as i read the answers of the other comenters)

  5. Your son can take him to court and get back child support. If he were underage you would be able to do it with him.  This may differ in another state. I would call Child Support Enforcement in your state.
