Was the question of the right of states to secede from the union every presented to the Supreme Court?

Which decisions pertain to that issue?

  1. The only successful and peaceful succession I know of is that of Maine succeeding from Massachusetts.  I am not sure if the Supreme Court was involved.

    It is an interesting question, but I doubt it is the Supreme Court's decision.  All successful successions come at a cost of blood and the DoI and the Revolutionary exemplifies this.

    I don't think the Supreme court can rule on the rights of states to succeed, but they can rule upon the Constitution. No where in the Constitution does it outline the rights of succession or the right NOT to succeed.


  2. i'm not going to be much help at answering your question but i've been told that after the civil war and all the other previously seceded states returned to the union, south carolina did not. so that would make south carolina still part of the confederacy, right? i don't really know if that is true or not. i'm from south carolina and southerners love stories and legends. a lot gets made up. but if it's true, then it's a pretty darned interesting fact. good luck with your question. hope someone knows more than me!

  3. I believe it was decided! The states do not have the right to secede! I believe this to be unconstitutional, because if you can become a state in full standing you should have the right to withdraw as well!
