Road traffic incident - who is to blame?

Was driving up a hill on a main rd, car pulls out from side rd on my left, straight in front of me. They were trying to turn right to go down the hill on the main road. We collide, hitting the front bumper of each car. They argue I was indicating left to turn up side rd. I know I wasn't, but they notice that when I have my hazard lights on, the right side is flashing correctly, the left is on solid. So there are indications of a possible fault with my left indicator, but not conclusive, and when I turn off my hazard lights under their supervision, neither indicator remains on. Who is to blame?

  1. Any vehicle that is on a side road waiting to turn onto a main road...must yield to all oncoming traffic until it is safe to proceed....sounds like they didn't do that...it would be their fault.


  2. It does sound like it's their fault, BUT it could also be argued that you were partly to blame because you had defective lights.

  3. It would still be their fault for pulling out into oncoming traffic.

  4. They are at fault for thinking you might know what you were doing.    Also,  since they were coming off a side road,  you had the right of way.   They were wrong in moving before you were past,  and for turning out into your path.  

    True defensive driving is acting as though you are the only one out there with a clue.
