Roommate's lease is up but her stuff is still there. What do I do?

My roommate and I have had a falling out. She and I mutually decided to end the lease. She unfortunately still has her stuff there though her lease is up. What can I legally do with her things to get them out (california)?

  1. as long as her thing are there she is occupying the property.  you can sue her in small claims.  you don't have to store her property for an unreasonable time. unually 30 days.  i don't know about california. you can call it abandon and sell the good stuff and give the rest to the salvation army. give her notice in writing and keep a copy.  e-mail counts in court . look on line for landlord tenant law for california.


  2. Give her 30 days written notice that the stuff will be disposed of on September 16.

  3. Call her and tell her it is going out on the curb, then do just that.  She isn't paying storage fees to you...

  4. If it's your place and the lease was in writing, and is up, you can blow her out legally.

    If she just walked out and turned in her key, just pack her stuff up and store for 30 days, notify the sheriff and tell them where the property is and you're out of it.

    If the two of you are renting from someone else, the LL must go through the legal process if you feel she is going to be a 'legal threat' to you.

    all in all, you have not surrendered enough information or presented any documents to review for me to give you the exact process for you to pursue in your endeavor to remove her and her stuff from you for good
