Roommate from h**l, best way to kick his Butt out to the curb ?

I have a 5 bedroom house that i own that hasnt sold cause o fcrpa rela estate market...

my mom had a stroke and iv ehad to tkae extra job to help he rstay at nursing home.

i took in 3 boarders. they each have a bedroom. share 1 bathroom.

all guys (the chicks i interviewed didnt have stable jobs or money as deposit) anyway two of the three guys are respectful and seme to understand theyre NOT renting half my whole house. (theyre each paying about 1/4 what my house would rentfor total !)

But the 3rd boarder is nuts and controlling. he acted overly nice and becaus ehe had great references I ingored my gut that something was off...

So befor ehe move din i let him know I have 3 cats (i do animal rescue and their rescue cats)

plu i explained i work late and wake up late so need peace an dquiet in morning. also i said he coudl have 1/4 of kitchen cabinets to use.

He agreed to everything i told him.

Well sinc ehe moved in he has tol dme he has bad cat allergies (sin ehe was a kid)

and could i keep all my cats in the cellar !!! and that he wa srunning special hepa filters for his sensitive lungs.

my ex was allergic and never aske dme to put my cat sin cellar becaus emy house is big an dclean...

anyway he then proceeded to move around everything in my kichen cabinets and is taking up half th espace...

i sai di need quiet early morning and he keeps waking up at 7 am to mkae breakfast and loudly talk business on his cell.

argh. we have no lease drawn up......but verbally agreed to 8 months.

no way. what should i do ?

  1. make life miserable for him loud music till 4 in the morning ..shut off the hot water...better yet shut off the water period..if you live in the south shut off the air... Pile cat c**p in front off his beedroom door..In brief make life so miserable he can,t wait to move..tell his 19 yr old gf you think your pregnant by him etc etc..


  2. No written fixed term lease equals a month to month tenant by default.

    You must give him proper written notice to terminate his tenancy. Check your state's landlord/tenant laws to find the exact requirements.

    Most states require a full rental term (month) notice to terminate a tenancy, though it can vary by state.

    If he does not move per the notice, you need to evict him through the courts.

  3. if he is a month to month tenant, give him the amount of notice that is required by your state. you do not need to give him any reason to want him out. if he stays past the date do not accept rent. file for eviction and ask for damages(if you can).

  4. Easy Fix. Call the police to come over as you kick him out. You dont have a written agreement. Let them know that you feel that your well being is in danger and possibly your life. Let them know everything. Once they come over you can fill out a CT (criminal trespass) if he comes back to you property he goes straight to jail. As far as the police know, he was squatting. Right? wink, wink. Everything he does is an automatic eviction. Threatening you was the deal breaker. The law is on your side. Or you can let me come over and Ill kick his @$$ while his GF fresh outa the cradle calls to cry to her life coach.

    now i'll answer the question- you need to have all of your renters look over the lease with you, all together so that it doesnt look like you are making a statement to just him. You should ask them all to meet with you as soon as possible and go over all of the rules that you set, just to refresh their memories, and tell them that if they cannot follow the rules then they will have to go, and make sure that you dont back down on any rules, especially the cat thing, cause they are your cats and if he cant handle it then he needs to find a new place. tell them that you need people who are serious, and mature enough to pay rent and abide by the rules you have set. Make sure that the nice ones know that you want them to stay and thank them for their respect. tell them that you dont appreciate disrespect of any kind from anyone, and that you are going through a hard time, but you are not going to be a pushover and be shoved around. make sure that they all get the point, and to the big tall professor: make sure he knows that hes not your professor, but that you are his leaser, and you are not gonna take c**p from him anymore. but still be nice.

  6. Well, it's too bad you didn't write up all the details of your agreement.  You have no supporting evidence that he's not abiding by the rules unless your other tenants are willing to stand up for you.

    Tell him that your cats are NOT going to be in the cellar.  He knew before he moved in that there were cats and it's too bad if he doesn't like it now.  Tell him it's your kitchen, to put his stuff only where you told him to put it and not to touch anything else.  When he's on the phone remind him that you require quiet in the mornings, and he needs to make those calls from somewhere that won't disturb you.  

    If he gets snotty, call the cops.  Tell them he's trying to intimidate or threaten you and they will help you.  If you have brothers or cousins or male friends you might have them around for muscle, but you have to make it clear that in YOUR house YOU make the rules, not him.
