Question:

S.W.S. Inc.,Carrollton, TX is withholding paycheck because I took another job-what can I co to stop the spite?

S.W.S. Inc. in Carrollton supposedly has a good reputation but they are by far, the worst employers I have ever heard of or worked for. I was blessed to get out when I did. Luckily, there was a job offer still on the table from another employer, but when I quit, Dee Brennan, the Office Manager conveniently sent my check. She was well aware that I have a 15 month old daughter and that I live from paycheck to paycheck. She told me that I could have prevented it if I had behaved correctly. I attempted numerous times to explain I was unhappy with the job and that I was beginning to question wether I was cut out for the job. She responded by saying, "You aren't going anywhere." It is a creepy place to work. Someone in the office was stealing MP3 players, laptops and my cell phone right out of the office. It is obviously another unhappy employee. After attempting to do the right thing, I finally did quit and now I can't get my paycheck and it is pure punishment. What would you do?

  1. If you worked for them, they owe you the money, and htey owe it all to you on the next regular payday!

    Tell the company that you will file a formal complaint with the state if they do not pay you immediately (If more than one regular payday has passed).

    Here's the Texas Payday Law:

    "***If an employee quits, she/he must be paid in full at the next regular payday***. If an employee is terminated, he/she must be paid in full within six days. ***If an employee is not paid on a payday for any reason, including the employee's absence, the employer shall pay those wages on another business day as requested by the employee.***"

    "An employee who feels that he or she has not been paid all wages earned may file a complaint with the Texas Workforce Commission (TWC). Complaint forms may be obtained from local TWC offices, or upon request through the mail, through our agency website, or by calling 1-800-832-9243 /TDD 1-800-735-2989." ....
