SCOTS LAW: Can I take legal action against my university students' union?

Two years ago I was involved in an incident on the premises of my university students union. I engaged in shouting and swearing, as did the staff. I received for this incident a life time ban from all university student union recreational facilities.

There have been incidents where people have only received a 6 month ban for actual bodily harm. I have appealed the union's decision but was unsuccessful, and they say that there is no way forward for this case as the union is regulated by its own internal disciplinary committee, which has chosen to uphold my ban.

However, the students union is a registered charity, therefore surely it falls under the jurisdiction of the law as pertains to charities. In addition, I believe that this ban, in being disproportionate to the crime, has led to my reputation and future career prospects being damaged.

What legal action can I take against the university union?

  1. parasite. your just wanting to see if you can get a few pounds from them in some sort of compensation. no chance


  2. Any owned premises can refuse admission without reason or prejudice in Scotland; eg shops, cinemas, pubs and no doubt recreational facilities.

  3. There is a possible avenue to follow since SU membership is obligated by the University, which is a government body.

    In general a private body can regulate its membership anyway it chooses, since your choice is to join it or not as you wish. When, however, the government 'makes' you join it, then it has an obligation to operate in a reasonable manner.

    You could hire a solicitor, but expect an expensive fight.

  4. no, as it is also a private members club

    why has it led to your reputation being damaged? why not appeal to join  a club within the union (does it have a rag or a community club) and see where you go from there?

  5. If you have the finance you can bring an action against anybody , dont try to get legal aid on this one though , sounds to me that you are guilty
