SOL In Regards to Having a Joint Account With Hubby?

I have debt that was acquired prior to getting married. Now my husband wants to have a joint account with me. I know that creditors can come after the money in our joint account, but the SOL is up in a few months, would it be safe to wait till the SOL date passed, then open up an account?

Also, is the next few months a critical time for me to get sued by these creditors since SOL is coming to an end?

  1. As you approach the end of the SOL, it is more likely that you will get sued if you owe a significant amount. However, you need to be aware that just because you think the SOL is up, it might not actually be up for a variety of reasons (tolled by statute, extended by some act on your part, etc.)

    Furthermore, a creditor may still try to sue you and get a judgment even after the SOL has passed.

    But yeah, I would definitely wait and see what happens over the next few months.
