Saleman gave false information.?

A salesman got my wife to take a free trial for a vacumn cleaner and said that to cancel, all we would have to do is call by a certain date and somebody would come by to pick it up. After calling, they said the only way to cancel would be to ship the entire vacumn back. After reading the cancelation sheet i noticed that only the slip had to be mailed. We brought the slip to the post office that day. After a week, I called back and they said that the postmark was dated for the day after the cancellation date and that we had to pay for the vacumn.

Is there anything I can do about this? Is there any laws that they broke by giving us false info? I would rather not pay $1800 for a vacumn.

  1. If they already have your money, you might have learned an expensive lesson. If not, say you bought it on credit, tell your creditor the story and make them dispute the charge. Any reasonable shyster will back down from a challenge. And don't pay for it in any way further. Go way over this guy's head, past his boss' boss. Don't take it, or live with a butt reaming. It's not your fault you weren't there and the Missus must feel taken advantage of as well.  You bought about 50 bucks worth of motor, another hundred in design, 50 more in parts, and the rest is manure at a premium price. If you paid cash or check, it won't be worth your time to recover it. They expect this reaction and know how to deal with it. Good luck.


  2. complain to the store you bought it from. Demand to speak to the manager.

  3. Contact your local DA!  Also, if you call and complain enough they will eventual give you your money back.  You have to convince them you are going to kill there future busines by badmouthing there name until they go out of business.  I hope it wasn't Kirby.....

  4. Either talk to your lawyer or pay for the vacuum. Did you really expect to be able to use a $1,800 piece of equipment for free? Did ship the vacuum back to the company like the salesman said? If not, you are still using the product... Perhaps you could offer to buy it at a lower price now that it is used, but if you signed a contract your hands are probably tied. Your lawyer can help you with the terms of the contract and what the laws are in your state. At the very least you should have very clean carpet!
