Say i was smoking marijuana by my window and some one smells it or sees me and call the cops?

i live in wyoming. i sometimes smoke out my window and last night i wasnteven smoking and a cop drove by like 4 times and then he shined his spot light on my window. i was just wondering if they could come to my house and tell my parents or something. And could they search my house?

yeah the police has the right to search your house if someone calls them that they saw you smoking marijuana. and they probly drived by yopur house to see if you were doing it cause thay have to have proof that you did

Someone can report it and call the police.  They stop by, but cannot enter your home without a warrant or your permission.  If your parents or yourself let them in, they can search your home.  And to get a warrant, all they need is cause.  Smelling pot is cause, and it won't take long to get a warrant if they need one.  But if your parents let them in, you could be going to jail.  Just stop smoking pot and you don't have to worry about any of this c**p.

I think they can say something to you if they are suspicious, but they can't search your house without a warrant.

An earlier poster is wrong. They don't need a search warrant if there is probable cause, which included smelling pot smoke.

BTW, why would you worry about them telling your parents? I'm sure your parents know you're an idiot if you're the type of kid that would smoke pot.

Goes to show you even some cops don't understand search law. If an officer is at your door or somewhere else where he can lawfully be (sneaking up into your yard to sniff at your window isn't lawful), and he smells what he knows to me MJ, he can indeed enter and search without a warrant. The principle is that drugs are likely to be destroyed if time is taken to get a warrant. In that case, since you're busily smoking up the evidence, it's not an unreasonable assumption. This COULD go also for someone else seeing/smelling it, but the question will turn on just how credible is the person reporting. Are they a "solid citizen," are they reasonably likely to know that smell from others, do they describe typical dope smoking, are they willing to go on the record. All those could come into it.

There is a legal principle set forth in the Plain View Doctrine, that allows an officer to enter without a warrant if he sees illegal activity. This has been expanded to include the odor of burnt marijuana.

They can enter, secure the persons inside, seize anything in plain view, and use that information to obtain a search warrant.

Even if they did not observe enough to justify an entry, there is nothing preventing them from calling your parents and advising them of what the observed.

No they can not do that..I have an ex boyfriend who is a cop and the only way they are allowed in your house is if they have a warrant and you and your family should not be under any suspicion for the cops to have any warrant to come into your home right.......if so just flush the weed lol

A) Your parents are stupid enough to invite them in.

B) They have reasonable suspicion meaning they see you smoke,  if they just smell it, that's not enough.

C) Your stupid enough to invite them in.

The neighbors can call the police. The police can drive by and shine a spotlight on your windows. And, if they notice something suspicious, they can get a search warrant and search your house.

Smoke it in the basement or something. If you have neighbors that are that uptight, it's just not worth it.
