Say that a pregnant lady is touring the United Nations and goes into labor...?

If the baby were born in the UN, of what country would it be a citizen? Similar question for embassies...if a child was born in the French Embassy in the US, would it be a French citizen?

  1. By international law, the child has the citizenship of its parents, no matter where it is born.  Our 14th Amendment trumps that, and confers isntant citizenship on anyone born ehre.  It needs to be revised to eliminate that unearned boon.


  2. Contrary to popular belief, Embassies are NOT the 'soil' of the country they represent.  They are simply protected under the Vienna Convention on Diplomatic Relations (see the reference below).

    If the lady gave birth in the UN building, the child would acquire whatever citizenship is allowed by the countries of which her parents are citizens plus - unless the parents are diplomats assigned to the US - US citizenship.

    If the baby were born in the French embassy in Washington, the same rule would apply.

  3. If the woman is mexican the baby will probably become a US citizen. Send em all back over the border. Man we need to change our laws.

  4. I'm not 100% sure but I think the land an embassy sits on is considered land of that Embassy's country. The French Embassy on American soil is French territory. Vice versa for an American Embassy on foreign soil. Now, if the baby is born in the US he/she is probably an American citizen because the Constitution makes no distinction in this case. it simply says if you were born in the US you are an American citizen. My guess is the baby would hold dual citizenship...the US and the citizenship of the Embassy it was born in. I may be wrong.
