Seat Belt Ticket in California?

I got a seat belt ticket. the passenger in my car was not wearing a seat belt. Here is the question, the cop did not approach us until we had already gotten out of the car in the parking lot of my apartment complex. He came up and said, hey can I talk to you guys for a minute and then told us the passenger wasnt wearing his seat belt at a stop sign about 100 feet outside my complex. The cop never actually pulled me over. Is this allowed? I don't feel this ticket was issued properly. Any insight on this issue would be great.

  1. NO DON'T PAY. I ran through a yellow light seen the cop made 2 lefts and jumped out was seen walking away from the car the cop asked me why i just out and walked away and i told him so i didn't get a ticket. NOT IN YOUR CAR ITS NOT A TRAFFIC STOP.

Yes he can do that without pulling you over.  How do you think they issue tickets to people who get caught thru traffic cams  without actually pulling them over?  The only way you could get out of this is if the officer who ticketed you was off duty.  Otherwise, I don't think you can fight it.

  3. Just go to court and contest the ticket and explain this to the judge in charge, this would be your best bet and good luck.

  4. deal with this as soon as you can. i received a seat belt ticket from chp last year. i never received the fine in the mail because they mailed the paperwork to my old address even though i gave the officer my new address. long story short...  a bench warrant was issued for missing my court date and 300 dollars in court costs were added to my fine. all for a 50 dollar ticket. don't sit on it. get the issue resolved as soon as possible.

  5. In New York state law. In front of car. Must wear Seat belt. And Its your responsible to tell passenger to wear seat belt. and must wear seat belt even on parking lot. wear it all the time. and Cop is watching everyone. and look for safety issues. In Cop's mood.

This is a tough one...Regardless of the circumstances of how you were "pulled over," you still got flagged...I don't think you'll get much sympathy from the court because it is a safety issue...The driver is solely responsible for securing all passengers and cargo in or on a vehicle...Just make sure it gets taken care of else you see what happens
