Question:

Seattle Parking Ticket - Unmetered Space?

I received a parking ticket for one of the areas where it's 2 Hour Max Posted Parking. This is not a metered spot and I didn't see any chalk on my tires. Being that the city has the burden of proof is this one worth fighting. How can they prove I was there for more than two hours?

  1. All tickets are worth fighting unless you like giving money away. Take picture of the spot go to court date plea not guilty and ask for a jury trial. Because this is a criminal suit against you. They have to the burden of truth on them. Most people won't fight it because 75 dollars or so doesn't seem like that much, and our time is worth more. They want you to think that way so they can keep fining whomever they want. The judicial system is working under fraud it's time we stand up for our American Citizens Rights

  2. If you have some sort of proof that you weren't the two hours -- like receipts from two places not in walking distance within the two hours, then you have a case.  Otherwise, you can go to court and hope that the ticket-writer doesn't have proof.  I don't know how they do it in Seattle, but in some jurisdictions, they record tag numbers and times on a computer.  That's awfully hard to argue against.  If it boils down to your word against the ticket-writer, a sympathetic judge >might< give you a break.  me, I'd be inclined to pay the ticket just so as not waste a day in court.  Especially if I was guilty.

  3. pay the man

they have heard those excuses 1000000 times

You are guilty as charged.  You cannot use a weasel clause to get out of it.

Do you  want to spend a day in court fighting it

  4. A lot of Seattle is covered by video cameras mounted on traffic signals so pay the fine and move before the 2 hour limit next time. In addition the officers log can be used as evidence in court and that is why you didn't see any chalk marks. The computer log will show the first time the officer "tagged" your vehicle and when they issued the ticket.

  5. The time stamped photos will suffice as proof.  The log of license numbers the parking enforcement person made during their rounds will work.  The chalk you DIDN'T see will work.  It is possible none of these exist.  My point is YOU don't know they don't.
