Second mortgage with quit claim deed?

My mother purchased a home for me and added me to the deed with a quit claim deed. My question is, can I apply for a second mortgage on the property to do a home improvement if I have been quit claim deed but I am not on the first mortgage? Thanks.

  1. All the quit claim deed did was muddle the title here. You cannot get a second mortgage when you are not on the first. Straighten this mess out. A piece of property cannot be transferred legally without a release of deed of trust if there is a mortgage on it.


  2. Second lender would not allow it.

    This is because they will assume the first will no longer be paid and they will end up losing their money in a foreclosure.  They will make you straighten out the title first.
