Security deposit?

My sister and I rented a property owned by my father. He has not lived there for 2 years and there was a short term tenant inbetween. There was some tension so my father hired a management company. We received the tenants security deposit and held it in a escrow account.

The management company is trying to charge the tenant for damage that was there prior to them moving in. We explained that all this was there prior but they dont want to listen.

We feel the whole security deposit should be returned to the tenant. Since we have it in an escrow account, what can my father or the management company due if we return the security deposit to the tenant.

  1. What do you mean -- the management company doesn't want to listen. They were hired by you! Let them know if they don't return the money they will be fired and reported to the better business bureau.


  2. Simple--Fire the management company and take care of business the way you see fit

  3. They can take you to court.  There are small claims courts that are set up for this type of thing.
