Seller didn't include lien release?

I purchased a truck a few months ago and when I went to transfer the title I noticed there was a lien and the seller did not include the release. I called the bank and it was paid off but they will not give me the release paperwork and I am unable to locate the seller. It was a private part and the truck was not at her home, and the address on the title is her old home I found out! What can I do plates are about to expire and I will not be able to drive my truck!

  1. You didn't hear this from me.... but if there there is a spot on the title for a signature for lein release, just scribble a name on it with a date from a few years ago, they'll never question it.

    Be sure there is no lein on it.

Anytime you purchase a vehicle, you should check the title for legal owners suggesting a lien, and get a lien release at the point of sale.  Since you didn't do that, looks like you have a vehicle you won't be able to put in your name and drive unless you can find the seller and have him get the release, remove the legal owner, and sign the clear title over to you.

    If you indeed can't find him, you might be able to use a title service, but it's going to cost from $200 up to do so.

  3. Ask the bank if they can give you a notarized statement stating that the loan has been paid in full.  It's worth a try.  You also may want to call consumer protection in your state for guidance.  You know that this has had to happen before.
