Seller refuses to cooperate, How can i title motorcycle?

I purchased a motorcycle from a private seller. Firstly he claims had title, But what actually had was MSO. He purchased from a dealer in 05'. I have spoken with dealer, all legit.

The hoops I have jumped through have led me here, I sent him information about how is responsibly to title vehicle. Even so far as, if needs Power of Attorney I can assist. Seller is unwilling to assist.

What can I do?

Technically he is the only one who can.

I live in Tennessee, just FYI.

  1. Why can't you use the MSO to title the bike in your name? Granted, he was supposed to take care of this himself, however, if all the paperwork from the dealer to your seller, and then from the seller to you, I don't see why you cannot transfer to your name. The MSO is the "birth certificate" of the car and should be just as good as a title that would be issued after the MSO.


  2. Haul his f***y into court and request the court to order the seller to produce.

  3. It is his responsibility to provide you with a merchantable title at the time of the sale.  You should have never forked over the money without getting the title at the same time.  Legally, It is still his cycle and you cannot title it it til he provides you with his title to the cycle.  Tip:  DO NOT OPERATE this cycle til you are the legal owner.  I guess you will have to see the police and/or call a lawyer.

  4. Yep, technically, he can't sell the bike until after he titles it himself.  

    So, he can either cooperate, Monday, or you can go down to the police station and file charges against him.  That's it.  He didn't "sell" you the bike - he took your money and promised to sell you the bike.  He needs to return your money, or hand over the title, or go to jail.  

    Print this out and show it to him.  His call.

  5. He has to deliver title upon sale.  A MSO isn't exactly the same as a title.  Take him to court or buy another bike.
