Question:

Seller says they will sell me car through email, is it a binding contract?

I recently offered someone a decent price for the vehicle through auto trader, and he quickly responded accepting my offer saying he will sell me the vehicle, it's a used motorcycle, now... he's not responding and doesn't want to sell me the vehicle however he already said he would in an email...his words exactly were "yes...lets do this deal".... Now if he doesn't sell me the vehicle... could i possibly sue him? is confirming yes through an email a legally binding contract?... and what if he sells it to someone else?

  1. E-mails are not usually admissible as evidence in court, because they can be altered easily.

    I'm curious... was he offering to ship you the bike, use eBay or Yahoo as a medium, etc?


  2. CAN YOU SUE HIM ? Yes.  Are you going to win...no.  What are you going to sue him for?....The car, if he sold it to someone else there is no judge that is going to make the other person give you the car.  You have to sue for damages...what are your damages?  YOU DID NOT BUY THE CAR. but how where you damaged?  You did not get the car, but how where you damaged because of that.  You weren't.  You are going to sue for money, but you are not out any money.  No damages.
