Selling a house with leins after filing bankruptcy?

I am selling my house and have found out there are leins on it, after further investigation I found out that my lawyer overlooked the leins since I chose to keep the house. I need to find out what I can do now.

  1. There are several things you can do about the liens.

    #1  Challenge them find out if they are yours and why they were placed on your property

    #2  Offer to pay them a discounted price to clear them from your house.

    If they agree to pay a discount, have them send a demand to the escrow closing agent referencing the account number and stating that this constitute the entire amount owed.

    The bottom line is the liens holders must agree to remove themselves and send a statement indicating so, or you have to pay them off.

  2. You have to pay the liens to remove them.  Since they were ignored during your bankruptcy, they are still yours.  You can't make them go away.

  3. You fill out massive amounts of paperwork in order to file bankruptcy, so really, you overlooked the liens.  I doubt you have any recourse.
