someone i know sold a minivan to someone else and they didnt have a title to the auto and the buyer said that was fine and bought it as is,then came back later saying that they should be responsible for paying the fee for filing for a lost title, are they responsible for that even though the buyer agreed in the first place to buy as is,knowing full well they would have to pay that eventually, unless they are just stupid,im just not sure.

  1. yes

  2. Only the person who's name is on the title can file for a replacement title.  It doesn't cost much.  Just tell the seller to do it.  If he wont the car must be stolen or something.  Never buy a car without a title for future.

  3. You can't sell a car unless you have the title.  The new buyer can't file for the lost title.  So, the seller has to take care of getting that title.

If the buyer wanted to be a total pain, they could make the seller take the car back, as it's not a legal sale without the title.

  4. Probably just dealing with an idiot.  You never know what people think, or know, so you have to ask sometimes.  Some people buy cars without title every week, and other people are going to be first-timers.  These first-timers may think they can just ask for a title at the DMV and get one.  Others may know they can't get a title, but they can't stop dreaming that they'll get one some day.  I have actually seen project cars for sale that were being restored by a person who didn't hold the title.  That's insane.
