Selling building in Illinois...What are my tenants rights?

I have a building in Chicago and am going through an eviction with my only tenant. He has not paid rent in three months. I am going to be selling the building before we even get to court. Will the new owners have to go through the court process to evict him or is he automatically out because there is a new landlord? This tenant does NOT have a current lease.

  1. Dang.   I am not 100% sure, but I would continue with the eviction.  It is your contract he broke, you are the one he owes $$ to.

    Tenants go with the property, he is not "automatically out" with the sale.


  2. Once ownership changes the eviction process begins all over again. Most buyers won't accept a problem tenant. It could nix the deal.

    Have you offered debt forgiveness plus $500 to the tenant? $1000?
