Sent a validation request to a law firm

i sent a validation request to a law firm by overnight mail. the postal service tried to deliver on a saturday but no one was there. the postal service left a note that said they(the law firm)have a package to pick up. the law firm still has not picked up the package and the post office will return it to me in 5 days.

do i have to send it to them again? it costs me $16 already.

  1. No, no, no do NOT send validation requests to the creditor (in this case the law firm)....of course they're going to say it's your debt...they're trying to collect remember?

    You send a debt validation letter to the credit bureau for validation.

    They have 30 days in which to respond.


  2. You did it correctly. I think Anjell is confusing debt validation with disputing.

    The law firm is (most likely) a third party assignee...NOT a creditor. As such they are covered under the Fair Debt Collection Practices Act. You would send a debt validation request to them directly.

    I think you did a bit of overkill on the whole "overnight delivery" thing. You can just send them a DV letter as outlined below. Check out the source for a decent overview of the process.

    "What is the correct way to ask for debt validation?

    Send the collection agency (CA) a written request (DV letter) to validate your debt. The letter must be sent via certified mail (CM) with a Return Receipt Request (RRR).

    Remember to save the CM receipt, the RRR green card when it comes back and your USPS receipt (CM # is on it)."
