Septic tank issue, grandfather clause?

trouble with an old septic that has several familys on it, but is grandfathered in,what can i do...

  1. My guess would be you have two choices, either talk with your neighbors who are on the same septic system about pooling together to cover the repairs on the system, or talk to your local utility about getting hooked into their sewer system if it is available.


  2. The problem here is whos land is it on? Everyone involved with this old system is going to need to install their own septic system or tie into the sanitary sewer line. You can repair or maintain the old present system - which I believe all parties should pay their share. I hope this is covered in some legal document or this could get expensive to resolve this legally.

    If it is totally beyond repair, you will need to get a permit for all new septic systems.

    I would search for any mention of this in the abstract or other papers. If you cannot find any documentation I would proceed with having a contractor see if they can repair the existing system explaining to them that they need to keep this grandfather system working.

    Then if it is on your property and there is no mention of it in anyone's documents, I would send a certified letter to each party explaining what the cost are to repair it, and state if they would like to remain hooked up to this system that they need to sign the contract of the septic repair contractor as a party involved for their share of the amount
