Serious accusations, please help!?

I was called into a 'confrence' with my horrible boss and a man named Jim, who supposedly works with loss prevention. They start by asking me if I know the World MArket employee discount policies, I respond with a"Yes, only immidiate family and I can use it," he then corrects me and says only immeidate family that lives with you can use it. So I then assume this confrence is about the fact that I let my friend use my discount card several times. They ask me if I remember some certain purchases, I remember some of them, Jim then asks me to tell him how these purchases were paid for, I then realise they were paid with a WM gift card. He then says that a miss Destiny Norman(my firend) had recently returned some itmes that hadn't been sold, in Tucson, this year.... Ok? He then accuses her of stealing these items, returning them for stor credit, and then using it with my employee discount card. I tell him she would never do such a thing, and that if these items have been stolen(I didnt know what these items were yet) that I did not know. He starts throwing accusations at me, indirectly calling me a liar, telling me to confess otherwise they'll have to bring the authorities into it. They even claim to have contacted 'miss Mornan', and have already recieved a statement from here, directly after he says this, he says he'll need me to confess by the end of the day or they'll take legal action. By this time I'm sobbing and I refuse to listen to them, I know my friend would never do such a thing, she'd never steal, and she'd never lie and accuse me of stealing, so I demand they let me speak to her, they don't. Well, I speak to her late that night, she's infuriated. She tells me there's no way in h**l they could have contacted her, because she specifically gave them the wrong number on the return slip(the return slip asks for you address,name,DL# and phone#) so that they wouldn't call her to advertise.So, they lied to me to get me to accuse her of something she didn't do. Or to get me to confess to something I can't confess to. They also lied when they said these items had not been soled in Tucson,this year, because when I finally realised what one of the items were, I recall selling that very item no less than amonth ago in my store. My family wants me to hire a civil lawyer, and my friend is willing to take this to court as well. The ONLY problem is, I do not have receipts to either of these items, the item that belonged to me, I've owned for nearly a year, the item that belonged to my friend, she got as ahouse warming gift when she moved into her 1st apartment, a year ago. What should I do, and CAN they actually DO anything to me? They fired me, obviously, but I wouldn't go back to work for them even if I did get this cleared up, or if I did sue. I don't however, want my work history to be ruined. Please help!!!

  1. If this is an unemployment question, file for benefits. If denied benefits, ask for a hearing. If and when push comes to shove, tell them to put up or shut up. Can you sue them? Probably not. But they were just fishing, anyway, or they would have gotten the cops into it already. They have no case, and you have no job. That's the long and the short of it. Go get another job.


  2. I really don't think there is much you can do about it. The first thing they asked you was if you knew the store's policy for employee discounts. You answered "Yes, only immediate family and I can use it!"  They then correct you and say "Only immediate family that lives with you can use it." Neither what you said or what they said regarding the policy, includes "your friend".  

    Through their interrogation of you they got you to admit that you had let your friend use your employee discount card. They may not have had any evidence that any items were stolen. By making you think they did, they scared you into admitting that she used your discount card with a gift card to purchase items.

    Had they not done it that way, you may have been able to say that she had returned items she bought for store credit and then gave you the gift card to buy things using your employee discount. You would not be breaking store policy if you used a gift card ( a card she could have given to you as a gift) and your discount card, but you did break it as soon as you admitted that she used it.

    They could have been fishing for more to see if there were any criminal charges that could be filed against you or her.  Regardless, they now had grounds to fire you. You were aware of the policy and you admitted to breaking it.

    Find out what the companies definition of "Immediate family" is. I looked up several different definitions of "immediate family" on the internet and can't find anything that would include your friend as an immediate family member. Even though you lived in her house, if she wasn't related to you by blood or marrige or wasn't  a "registered same s*x partner" with you than i'm afraid she doesn't qualify.

    Sorry, I  can't give you better news.  Don't take this as a foresure thing though. It's best if you get an employee manuel from the company and find out what their definition of  "Immediate family" states.

Buried in this long explanation are a couple of things that give me pause.  1)  You knowingly violated the employee discount policy by giving your card to a friend to use and 2) your friend deliberately gave a wrong phone number when she returned the items.  It's doubtful that they will pursue legal charges and will let it go at firing you; but, I wouldn't advise wasting your time or money with trying to sue.  As for your work record, most companies will only give out the length of employment if contacted by a perspective employer, so you probably don't have to worry about that.  The best thing for you to do is to follow the rules of your employer and be wiser in choosing your friends.
