can anyone define what exactly an over stayer is? my partner had a visit visa in 2006 it was expiring on the 1st aug 06 as he has a ghana passport but is a legal resident in italy. on the 31st july he was in france where the bus to italy was cancelled so he arrived back to uk by bus on the 31st july 06 his passport got stamped by the immgration in uk and then he took a bus back to italy from there? am i right in saying he is not an overstayer as he left b4 his expiry date. also he never got a stamp back to italy on the bus they just checked his passport.

    If you want a serious answer to the question (and a legally compliant answer) why not use the official channels - I've added the link below.

    The Home Office provide status checking facilities, general helplines, email options etc. so no-one has an excuse for being here illegally.

    The phrasing of the question suggests to me that you already know he's an illegal but you just want someone else to blame when he gets caught (as he will)

The problem as I see it is that the UK stamp shows him entering the UK again in 31 July 2006 but as the Italians didn't stamp his passport to show him entering Italy after that date question marks may be raised about where he was & the assumption may be he stayed in the UK, unless it can be proved otherwise but I really think you need to speak to the Home Office to clarify things.

  5. well, if hes a resident(meaning he has a greencard) then he doesnt need a visa.
