Serious questions about a moron running into my car?

This totally moronic woman cut into my lane and hit the side of my car..her insurance company has called me twice and I haven't talked to them, I heard you're not supposed to. I filed a police report right away, but I haven't called my insurance company..should I call them? Or let hers deal with it? Will my rates go up?

  1. Notify your insurance company right away.  THEY will deal with the other insurance company on your behalf.  Your rates will not be affected if you were not at fault.


  2. You absolutely have to talk to your insurance company AND hers to get things moving. When I was involved in a similar accident a couple of years ago (an idiot making an illegal left turn), the payment for my damages was held up because my insurance company couldn't get a statement from him.

    Call your company NOW. Not tomorrow, not after dinner -- call them immediately and tell them all of the details of the accident, the police report, the other driver's insurance company, etc. The longer you delay, the longer it will take for you to get compensated.

    And no, your rates usually will not go up for a single accident which is not your fault.  

  3. Honey you are stupid. Of course you talk to her insurance company, they're the ones that are going to be paying for your damages! Your rates will not go up, hers will. You need to call your agent and say "Hey, some lady with soandso insurance hit me, I need you to file a claim for me." They'll take care of the rest.

  4. Now would be a good time to take out a little aggression on some people who really deserve it. Just think... now you can use your auto as a tool for revenge against neighbors, co-workers, in-laws or random victims in the JCPenney parking lot and her ins. co. will pay to repair it. How much fun it'll be to scrape your car down the side of "Mr. Combover from the office" 's prize sportscar and be able to just drive away.... remorse free.

  5. You need to contact your insurance co. As long as there were not any personal injuries,you probably don't need a lawyer. Your ins. rep. can probably advise you as how to handle further calls. It is important that you call your company at once.

  6. You won't talk to her insurance company and you haven't called yours? How do you ever expect to get any money? Filing a police report won't help you get money, one or the other insurance company (or perhaps some of each) will be paying your damages, they will only use the police report as part of the claim records

    Talk to her company (whoever told you not to is wrong). If she is admitting blame, you can probably let her company handle everything and you won't need to call yours at all.

I would contact both your insurance company and her insurance company.  You should have liability coverage.  You insurance will open a claim and they will contact the other driver to make sure you are protected incase that driver says you changed lanes into her or something like that.  That way they will fight for you and you don't have to.  

    For your car, I would first call her insurance and see if they are will to pay for it.  If they are then they will pay for your damages (reasonable and necessary).  If they refuse and say well our driver says you changed lanes so we think you're at fault then (if you have collision coverage) your insurance company can pay for your damages less your deductible and then go after them and fight them.  If you don't have collision coverage then you will have to fight them yourself, argue with them, or file suit against them, etc.  

    Both companies will ask  you  your version and want a recorded statement.  Unless your partially at fault I don't see why you wouldn't be willing to give one.  If you're still unsure about it you can say I don't want to be recorded but still tell them what happened.  

    When you report it to your company your rates may or may not go up, that varies by insurance company and their procedures.
