Sewer backup in my apartment, I have not been able to cook, or sleep there. ? should my rent be prorated?

Happened on Saturday, and it is Tuesday won't be done til tomorrow.

  1. I am sure that is you approach your landlord in a reasonable manner , he or she will have compassion on your situation.  If you start whipping out the landlord tenant act at them, they will most likely become defensive and find a way to wiggle out of any foreseen responsiblities..

    Just explain the situation and ask what they would do if they were in a similiar situation.. We are all human beings and are compassionate people.  Accusing people of wrongdoing and expecting them to take action is perhaps not the best way to get what you need.

  2. First check your lease. You as a consumer may prorate the rent as long as you put it in an escrow account and notify the landlord through certified mail. You must place the money in the escrow account or the landlord can evict you for non-payment of rent. You just can't hold on to the money.

  3. Definitely! There are guidelines, however. Google Landlord Tenant laws for  your state and county.....you may have to call the health dept. as well. Been there done that....Hopefully your landlord will be open for discussion before you have to take measures. But, arm yourself with printouts, etc. proving your rights. If you dont find it on google you have two other options: One would be Renters Rights - look in your phone book under city/county section OR go to the Library and they have reference books on Landlord/Tenant rights as well. Copy the pages that refer to your problem.
