Shall I be afraid of an absconding report by my former employer?

I work in the U.A.E. in Abu Dhabi and my former employer threatens to report me as an absconding at the Labor Department after my transferable visa expired, this after he gave me an N.O.C. after submitting my letter of resignation.

FYI, my transferable visa expired after 30 days when according to my new employer, my application papers for the new visa got "lost" at the Ministry of Labor.

Also, my new employer promised my former employer that they will pay the fine after my visa expired but my former employer is bent on reporting me as absconding.

Will this in anyway affect my visa application, and will I get a ban? Can I make an appeal at the Labor?

  1. What are you worried about?

    Your former employer can not report you of absconding as long as he knows about your whereabouts. He received your resignation and gave you a NOC.

    Your papers got lost at the Labor Department? That's their problem. Let the PRO of your new company deal these things and do not worry about threats from your former employer regarding the absconding case. This makes no sense after they provided you with a NOC. A false absconding report will be heavently penelised.

  2. Generally speaking, it is better to go to the Ministry of Immigration and explain your situation. Take enough cash to pay off your overstay or you could end up in handcuffs. Also, if you are not muslim, it helps to take someone with you that is muslim and knows your situation. If nothing else, your case will be cleared. The only way they can generally ban or Blacklist you is if you do something wrong. There are only a few cases I have seen where someone was blacklisted and it stuck for more than 3 months, those people all broke the law and its understandable (Prostitution, or Drugs). Do the right thing and it will help you out more than you would believe.

    Be safe either way, notify your embassy when you are going to immigration as well. They can track any progress with your case if needed as well.
