Sheriff Sale on Credit Card Debt?

I have asked something like this before but I need more help. My husband has bad debt from before we were married or even together. They are all credit cards and he has three judgements against him. The last time I asked I was told that a Sheriff sale wouldn't be done on credit cards... Well here is the tricky part. I am the accountant of a carpet company and my boss just made me do one on a guy that owed the company $300. They are taking his Bronco! For $300. Anyways.. I have looked online and can't find anything regarding this for Pennsylvania. I don't own a house but I do have a car. Would they do a sheriff sale on that because of his credit card debt? Thanks

  1. I have never heard of it.  I have heard of someone with a judgment getting his bank account taken.  They can also just put a lien on the car or house, making it impossible to sell until the debt is paid off.

    As far as the Bronco for a 300 debt, what's the problem?  Are you saying that, if it's a small bill you should be able to ignore it?


  2. This is one of those "depends on what state you live in" questions...but in most states they can seize property resulting from an unsecured debt.  

    Unfortunately most of the people who respond on Yahoo Answer refuse to take two minutes to research their answer, and make themselves look terribly stupid with their answers.

    I live in Michigan.  If I wanted to get your property I simply go to court, file the proper motions, and a sheriff will go to your home and seize whatever property you have for sale at auction.  It rarely happens because it's very time consuming.  It's more efficient for the creditor to go after wages or bank accounts, or even your state tax return check.

    I used to raise birds, and I sold one on credit to someone for $900.  They stopped paying, so I sued them.  When they found out I filed to have a sheriff go and seize the bird they finally coughed up my money.  

    But trust me....they can take your property if they want to go through the trouble.
