Shoptlifting charges let go from sears?

hi,

I live in new jersey and the other day my friends and i decided to go to sears to BUY dress clothes for a formal shindig we were invited to.

so anyways, we get to the dress clothing department (we are all 18 year old males) and my idiot (ex)friend told me "hey take this vest and go in dressing room and put it under your hoodie." i said "no." now knowing im not the smartest person in the world, i went and did it anyway. so after i did it, we left the whole store back into the mall.

we got to the elevator on the other side of this mall when we were confronted by a large plainclothes LP guard who told us to come with him, on the way there he asked us "so, wheres the vest?, you dont tell me im calling the cops" well im an honest guy but when it comes to peer pressure im stupid, i told the guard "sir, here it is im so sorry, i didnt mean to take it" and now im panicing. he turned and said "your fine i got my item back, no charges are being pressed."

so he takes us to merchandise pickup which is by the outside doors of the sears and puts us in a small room.

after about 5 minutes he comes back with a folder and asks for ID, we all gave him our IDS and then he said "im am glad you guys cooperatated, best situation ive ever handled. im glad you guys learned your lessons, but i do need to say that you are no longer aloud in sears stores for the rest of your time on earth. but what i do need is you to sign this form saying you shoplifted the vest or i have to call the cops." so i signed it and then he said "ok we are not taking any further than this so you guys can be onj your way, but if you comeback we will charge you for this and next time"

my question is: if he told me to sign this paper and all. is this going to be on criminal record if the police werent involved?

no police were involved it was us and the guard only.

so i would like to know.

and also how do i get my criminal record checked?

  1. If the man said it, and you did it, then you should believe it.

    You were most fortunate an officer wasn't called. Talk about getting a reputation for life.

    Don't worry about a record.

    The only way a record could exist is if you were arrested, printed, and charged.

    I would have arrested you.

He gave you a "No Trespass"  form, this means you are not allowed on any of Sears property or like wise for the remainder of your natural life, sounds huge, but after a few years is no big deal if you use the store properly and pay for the items you wish to obtain outside the limits of the POS area. This form does get sent to the local police station and sears, but is not shared with law enforcement outside your local community. Sears will add the file to their national database. PS , you were honest, people like that I do the same with.

    You shouldve been arrested and prosecuted to the fullest extent of the law.

    One of the reasons consumer goods are so expensive is because of thieves like you.

    And now you have the audacity to come in here and ask about getting a criminal record checked???

    UNBELIEVABLE!

    Smart up, man up and STAY HONEST FOR THE REST OF YOUR LIFE.

    Then you won't have a record to be checked.

  4. No, it won't go on your record at all. Unless of course you go back in there and they recognize you.  went through the same thing and they told me never to come back but I was back in there a month later. They can't remember faces. Just change your appearance a little and don't attempt to steal again.

    Take this as a lesson.. NO MORE TAKING THINGS.

    Just about everyone has stolen something once in their lives.  I would say don't do it and you'll never be embarrassed about it again.

    If you don't have the money to buy it, you don't get it. You can live without it.

  6. no, a criminal record only can come from dealing with the authorities.  Don't fall under peer pressure...you are old enough to know better.  You go and do something stupid becuase a friend says to do it and meanwhile he doesn't do it....if the cops had been called it would have been you charged, not him or the others...you are responsible for what you do in life....time to grow up.

  7. My guess is that what you did was signed an affidavit to the effect of a confession to theft. It's something that they can use if the WANT to press charges.

    In order for something to be put onto your criminal record, they would have to file charges (which they would have to inform you of), and you would have to be convicted of said charges.

    There are expenses connected to pressing charges and prosecuting shoplifters. Expenses that, quite frankly, are too great to bother with when it comes to the common shoplifter.

    So, that being said, there is likely nothing on your criminal record, but if the Sears store notices that you return (within whatever statue of limitations apply) and they want to put the screws to you (like if you shoplift again) they have evidence of your prior act, including a signed confession.  

  8. If they didn't report it to the police then it wont be on your criminal record.

    To get it checked, it costs around 30$, and you just have to go to the pig pen.. oops, i mean Police Station, and say that you would like a criminal background check, just say its to get a job. It'll take about 20 minutes.

  9. They did that so if you shoplift AGAIN in their store, you can't say it was the first time. To have a criminal record, you would need a trial and you would be notified, so you are safe.

    Man, you have a LOT Of excuses for what amounts to you stealing a vest. My friend told me, I didn't mean to do it, you call yourself honest but you stole. Give me a break.

No it would not be on your record the only real way for something to be on your record would be if you went to court ect  they cant say your guilty of something untill they prove it in a court of law and if you never went to court they cant put it on your record. Most likely that paper is sittin on the guards desk or in there computer and will most likely get thrown away after a year or two.
