Short barreled rifle question?

How hard is it to buy a short barreled rifle.Is this a AOW?I was just wondering how much extra this would cost, and how hard it is to do.I am not asking about a gun that fires on burst or full auto.

  1. HI I don't think it's an AOW, AOW typically applies to short barreled whippit with pistol grip if I recall correctly.

    An SBR is called a short barrelled rifle by the ATF.

    I know people on AR 15.com build them quite often it just seems to be a matter of paying the 200$ for the tax stamp to make the gun an SBR.

    I don't think it's that hard to apply for the stamp but I'm not sure how long the wait is for the ATF to issue the paperwork.

  2. I agree with what Gunner said but with one addition(if its on a ar-15 platform). If you're going to build it yourself rather than buying a completed one buy the short barreled upper last. If you own an upper receiver with a short barrel along with other regular length rifles with lower receivers that the upper will fit on the ATF considers that intent to make an illegal short barreled weapon. So make sure you get a lower receiver that's registered as a short barreled rifle before you actually get the short barrel because the ATF can and will arrest and convict you for something that they think that you might maybe have one day possibly been thinking about considering doing (aka thought crime).

  3. A short barreled rifle with less than 16 inches can be had in Texas as long as it has a pistol grip and not a rifle stock. They call it a handgun.

    That's how Thompson can sell a single shot 16 inch handgun that shoots .223.

    That's also how Ruger sells the ruger blackhawk in .30 carbine.

    Its not the round that it shoots its the fact that the weapon is not shoulder fired.

    So any rifle with less than 16" barrel that is shoulder fired is illegal, however if it can not be shoulder fired it is classified as a pistol/handgun.

    Other than that you have to have a license for it. In Texas a BATFE license is a defense to prosecution and not an automatic Not-Guilty.

  4. Just an SBR is easy, No it is not an AOW, It is a one time  $200 tax stamp, and a form 4. If it is a common platform (AR-15) most people just build it themselves by putting a pistol upper on a rifle lower.

    The part most people have a problem with is the ATF will not approve a form 4 without a Chief Law Enforcement Officer  (CLEO) signature. Mony police heifs will not sign a form 4. there are work around this by forming a corperation , corperations do not need a CLEO sign off. Also need to know what state you are in . Many states do not allow Class 3 (title 2) weapons. If it is illegal to possess in your state of residence, ATF will not approve a form 4

    (edited) My last approval, for a supressor, within the last year took 9 weeks to get through the NFA branch at the ATF. I went the corperate route, which clears faster then the personal route ... if going personal , expect a 13-18 week wait on your form 4

    (Edited 2 ) thanks man forgot about constructive intent. Don't buy a pistol upper until you have an approved form 4. The ATF can and will arrest you for it.

    (edited 3) Texas is a full class 3 state. Yes you can own an SBR there.

  5. unless your SWAT or in the military you can not get a 3 round burst or full auto rifle newer than '86. its a federal ban. you would have to get it off the black market which is hard and expensive. not worth it if you get caught with it.

  6. In Texas a rifle cannot have a barrel shorter than 16" although some antique rifles would be the exception.
