Should I be at any fault with this accident in someones driveway.?

Hi I drive a E250 Van for Fed Ex and I backed into a customers Driveway to deliver a Package. I Had to head back the same way I came so I chose to do this. I parked Got out and was walking to the customers door when I heard His Car Running. I started to walk up to his car when he put into reverse and ran into my Van. He called and complained that if I wasn't in his driveway he Wouldn't of hit me. Frustrated in Florida

    there could have a been a child there instead

    and you have to make a delivery there so you had business

    there

  4. This will most likely be your fault, from my understanding you are to never park your delivery vehicle in the driveway, you always park on the street...........

  6. believe it or not but my dad did this years ago.  my mom was sick and work sent her flowers.  well while he was at front door, dad backed out of garage and hit delivery van.  dad raised such a fuss, using the same argument, that the guy apologized to dad and brought him flowers back the next day.

    my opinion is that whoever was driving was at fault.  you are supposed to check that your way is clear before moving.

  8. You are not at fault. There are traffic laws for this particular situation. In Ohio it is called: Starting And Backing, Ohio Revised Code number 4511.38.  This the law you can read it for yourself.   http://law.justia.com/ohio/codes/orc/jd_... It applies to streets and highways. On private property those at fault don't get a ticket because traffic laws only apply on streets and highways. I'm sure others states have similar laws.

  9. How can you be at fault if you were parked?   He hit a parked vehicle and is upset that his stupidity (not looking) caused an accident.  

    The only other variable is Fed-Ex policy,  do they allow you to park in the drive?   (Our delivery person does).   And you were correct in backing in,  it is much safer,  you just got a look at the location and you won't be backing into and blocking traffic to get out.

  10. I guess it would have been your fault too if he ran you over instead of hit your van?Just because he was in his own driveway doesn't mean he shouldn't look before he backs up.

    the guy who hit you is whiner, just looking for some one to pay for his mistakes!
