Question:

Should I follow modified grievance procedure or 3 step grievance procedure?

My niece was working for a big children's charity and after her 6 month probationary period was up they wouldn't confirm her in placement - she found out she was pregnant during this period. Our problem is they didn't follow any of their own procedures (I've looked through everything they should have done) to address the 'reason' for non confirmation in post (e.g. her performance was never reported as a problem but suddenly after 6 months it was, but no opportunity for my niece to change ).

Unfortunately she wasn't in a union (dumb I know) so we've had to get bits of advice here and there. The outcome is she sent in a grievance letter relating to non following of probationary procedures (during this time they continued to not confirm her in post) and now after dismissing her they have asked which grievance procedure she wants to follow

I'm thinking modified as she is no longer an employee but is that right? Any help greatly appreciated - my niece is in a real state and is a good worker, very qualified for the job so it's awful this has happened.
