Question:

Should I get a lawyer? I signed up or insurance in june 07. they didn't take out money but sent me a card.

I received an insurance card and verified benefits, so I didn't think to check it out. Now they won't pay because I wasn't eligible for crew insurance, but I was told to sign up for it and never went to a benefits class. Now they won't pay, and they are telling me they can't do anything about it because no money was taken out...but I can't do that for them. Is there anything I can do. The bills are about 2500. Would a lawyer exceed this cost?

  1. Sad fact:  You did not pay for the benefits.  It was a mistake on their part but they are not liable for the bills.


  2. Not enough info to answer your question. Need a rep from your HR dept. or maybe if you feel better, call a lawyer and ask how they charge. Some will take money out of settlements, if one, and you owe nothing if you lose.

  3. You could try to contact your employer and see where the problem was. If your employer was supposed to pay and didn't, you might have a leg to stand on. Seems you would have noticed on your checkstub that the insurance premiums were not being taken out....

    A lawyer would almost definately exceed this cost. If you cannot get the insurance issue settled, see if the provider will accept the contracted rate they would have been paid had you had the insurance.
