Should I inform my auto insurance company if I hit a careless pedestrian jaywalking on a private property?

Pedestrian was hit on a private property

The pedestrian was not hurt (or very slighly hurt)

Police conlcuded it was not my fault

Police did not charge me with any offence

Pedestrian was careless and was jaywalking

Blind spot - couldn't see

was driving 30kms/hr

I called 911 and reported immediately

paramedics concluded no injury, however, took the pedesitrain to the hospital (just in case)

My question -

Now I am worried that Insurance company will hold me responsible and increase my insurance? Is it likley?

And should I inform the Insurance company or wait?

Would my insurance company immediately penalize me by increasing my insurance if I report?

What if I do not report at all?

What are the risks of not reporting?

  1. I would, just in case he decides to sue you. A careless pedestrian still has the right of way.


  2. I am an agent and would recommend you call your agent  ASAP so they have record you at least called them to inform them of the incident. Depending on the company..calling your agent doesn't automatically mean you are filing a claim. (With us you have to call a completely different number and give details,etc)You will not be affected/penalized  unless they actually pay out for your claim. Just because you were not cited doesn't mean the person couldn't sue you! People can sure you for anything these days. However, It was good that you called 911 and had a police report, it shows you did diligence.  Sounds like you will be OK but do yourself a favor and call your agent. Best of Luck!

  3. I would call your agent and let them know.  You are not filing a claim, though, so it should not count against you.  If the officer gave you an accident report, or a case number to retrieve a report, and it shows you are not at fault, then no problem.

    There will be no problems at all unless the ped decides to sue you.

  4. Unless you are cited (which you weren't) or the person you hit calls your insurance company, you have no reason to report, and you shouldn't. They will hike up your rate just because. Since no one was hurt and you weren't cited, don't bother reporting.

  5. By law, if a report was filed with the police department, then you need to report this to your insurance.

    If you do report, there may be a chance your insurance rates will increase a little bit.

    If you don't report, then things get a little muddled.  If the pedestrian never files against the insurance company, there is a chance they will never find out.  If the pedestrian files, or if the insurance company automatically comes across this record, then you may be in trouble.  They could drop you as a policy holder, or significantly raise your rates as a penalty for breech of contract.

    A good percentage of insurance companies do regularly check public records for such discrepancies.  My advice is to go ahead and let them know.  It may cost you a little, but it is worth the peace of mind.

  7. Yes absolutely report the NO FAULT accident to your auto insurance company as a precaution. Provide a copy of the police report if necessary. Also, I suggest you also have an attorney ready just in case the moron decides to sue you for his/her incompetence.

  8. I would not report it to the insurance it was harmless.  Your insurance has the opportunity to go up and hitting a pedestrian is big bad bozo no no!!!
