Question:

Should I receive overtime pay?

I'm working at the MN State Fair and will be working over 130 in 2 weeks. I asked about being for overtime but my boss said since it's a seasonal job I can't get it. I tried looking for the law that states that but I couldn't come up with it. Can someone help me or point me in the right direction.

  1. 40 hrs. a week, seasonal, or not, but if you have already started working for this guy. You are out of luck I am afraid, cause it would be your word against his, in a court. That you agreed to his salary, if you tired to sue him for your overtime, in small claims. Especially if he had long time seasonal help, he hires every year, for witnesses. Testifying thats how he has always paid, straight salary for the season.

  2. call your Attorney State Generals office in your State's Capitol....they will put you through to the Labor Law and enforcement section...but as far as i know...anything over 40 hours in one week is overtime...

  3. You qualify for overtime unless you meet one of the exemptions, which you can find at the site below and includes work at seasonal places. State laws may provide additional protections.

  4. Contact the Minnesota wage and hour division.
