Question:

Should I sell my condo because my neighbor above me is noisy?

I bought a condo about a year ago and I love it. It’s in Atlanta, close to downtown, and has everything that I wanted. MY PROBLM IS I have put up with a lot of noise from my upstairs neighbor. He plays his music all hours of the night....and I go to work early in the morning. It's so loud at times, that I can distinctly hear the lyrics.

He also has a very powerful surround sound system, which I feel is ok, but in condominiums, you must be mindful of people living around you…otherwise I feel that you should buy a house.

I have talked to him about it, as have others who live close to him. I finally reached my last straw and I called the police recently. They wrote him a citation.

My question to you is, should I sell my condo and move into a house because I can’t take it anymore!!!!!. I am sure that I can get a pretty big house for what I am paying now…..

You have a right to quiet enjoyment of your property.  In this case your neighbor is in the wrong, not you.  I would suggest seeing if the other neighbors would be willing to all sign a letter telling him to stop the noise.  If you do have a HOA then they should do some of the dirty work for you.  There is no reason you should be forced to move because someone else is breaking the law.  It might come to that, but exhaust all other avenues first.


  2. That is what you have a HOA for.

    Don't sell your condo.  File a formal complaint with the HOA.  They usually have more avenues than you do alone...such as forcing HIM to sell if he doesn't comply.

    If they don't, then keep calling the police.  Once he racks up a few fines, and eventually goes to jail, trust me, he'll stop.
