Should I sue? I sold my mini van it was in ill condition, the buyer was to scrap it?

I didn't handle my business the best. he promised one price through out internet conversations on craig list and then cheated me by 80 dollars

  1. Sue for what?  Did he talk you down in price?  Or did he just short pay you?

    Unless there's some fraud involved, I don't see what you could sue for.


  2. I assume this was an auto dismantler (junk yard) you sold to.

    If it is he is licensed by the state and is required to scrap the vehicle.

    Sometimes they resell instead of scrap and that is a violation of their license.

    If this is what happened in your case you can tell him you will report him to the DMV Investigator if he doesn't pay what was agreed.

    What I've told you is true for Calif and some other states. Not sure about where you live, where ever that is.

  3. If you had a contract (agreement) and he didn't live up to his end, then yes you can sue him for breech of contract.

  4. Contact a small claims court, fill charges on breach of a contract.  Use your email convo. as a means of evidence on your behalf.

  5. you should not have given him your van until you got all the money and give the buyer a receipt for it too.

    What proof do you have that he cheated you and paid 80 dollars less? Did he give you cash? Did you give him a receipt?

    80 dollars is a cheap price for a life lesson. What if you sold a house, then you could have been cheated out of thousands. Next time stick to the agreed price and don't hand over your stuff until you get all the money.
