Should I sue McDonald's for what almost happened to me last month?

I almost threw up at the county fair after one of the rides I went on, and all because they gave me one EXTRA nugget!!! A few hours before, I ordered a 20-piece nugget at McDonald's, and those McBastards gave me 21, so that extra nugget was enough to make me very nauseated after about a dozen high octane rides 2 hours later. Had they given me the 20 that I paid for, that one les nugget wouldn't have made me feel s naustious and on the verge of throwing up, that one extra nugget ruined a third of my time spent at that fair. I couldn't just leave that extra nugget in the car either, that'd be wadting food, so I had to eat it, but again, that extra nugget from them was like the straw that broke the camel's back in the sense that it was just enough to make me nautious and ruin my good time for a good half an hour. I felt better a half hour later and went on more rides, but for that good 30 to 45 minutes, my time at the fair was ruined by almost throwing up, and all because of that EXTRA NUGGET!!!

Yes, I think I should definitely SUE their McAs@es for their inability to count!

I do not believe it was the 21st nugget that put you over the limit.  Maybe you should have stopped at 10??!!  This is a waste of a question on yahoo answers if you ask me.  Grow up.  You cannot sue someone because you're a fatty and HAD to eat that 21st nugget.  If you ask me, there is no case here!

  15. well, if you could find a attorney to take your case you *could* sue, HOWEVER in order to file a personal injury lawsuit in the US you must show DAMAGES resulting from NEGLIGENCE.

    1. You have no damages (damages must cost money or be traumatic). You didn't ACTUALLY throw up! If you had you *might* have a case based on ruined clothing or doctor bills. Almost throwing up isn't traumatic for most people.

    2. It is not negligent to include extra food. It is not negligent to include less food, either. (that is a consumer fraud case pertaining to dept of weights and measures regulations, but in the case of a missing nugget you would simply ask the manager for another)  IF the nuggets were undercooked and you became sick from them, you would potentially have a case. But cases of food poisoning or illness are hard to prove.

  16. if anything, they should charge you extra for the nugget. and probably another .25 for the extra dipping sauce you'll need for the nugget.

  22. i get where u comming from ...they always f up my order which is always a burger are chicken sandwhich and i ask for just chesse and lettuce but being some mcbasters they always put mayo...and i hate mayo ..even the smell of it ...oh and to top it off they put one of there stuoid stikcers on the wrapper saying they double checked for accuracy..bull sh**...anyways i wish i could sue there mcasses too but we can't so just get over it already......don't go there anymore...!!!

    Now, there are a few ways you can go about this:

    Your first step should be to find yourself a good lawyer. Not one of those wishy-washy local ones-this is BIG, and for that you need a BIG lawyer.

    Secondly, gather some witnesses from the fair or the McDonald's-your family, the old cripple, a dog, whatever.

    Finally, try to get them for more. Go in disguise to that McDonalds and order the same meal, to see if they commit the same atrocity again. That way you can use it as evidence.

    Of course, this is all based on the assumption that you're joking, otherwise i deeply feel for all those around you...
