Question:

Should I sue the store or the lady?

I went to get a pack of rice, it was the only thing I needed to buy. At the check out, I had a little problem, I realized i didn't have enough cash on me so i had to go get some from the cash machine, when i came back i could see that the que had been held up and the woman at the counter looked very angry, so i quickly paid and left. I was carrying it out of the store when i realized someone had ripped a hole in it and the rice came falling out, all over the sidwalk, and i got it all over my new shores and all down my shirt. I was very mad, i think the woman at the till did it on purpose. I wasted that money on the rice and we really needed it as my hubby was planning on making curry and rice for dinner.

I told my sister about this who training to be a lawyer and she said we have a really good case and we could file a lawsuit against the woman at the till who we suspect did this, but she said it might even be a better case if we sued the store, i'm not sure which is best ?

  1. Okay, you realized this OUTSIDE? If there was truly a big enough hole it would have happened as soon as took the rice off the register. Leading me to believe this is not even true.

    Where is the proof that she did it? Besides, even if this is true, there is a good chance that it was ripped before hand, or even it got ripped by the belt or the plastic bag holder. Even, if this is true and she did do it on purpose it's RICE it's not like was something that could stain your clothes or hurt your body.

    Going on your assumption of suing, she would have as much right to sue you because you wasted her time.  People are way too sue happy now a days.

    Also, if this is true why don't you just exchange the rice at the store? They will replace it for you.


  2. How about you sue no one and GET OVER IT. You didn't get hurt. Jeez, be an adult and quit whining about a hole in a bag of rice. Maybe you should have been smart enough to bring enough money with you to pay for it. And then decent and courteous enough to not hold up a grocery store line on your dumbass getting cash out of a machine. You could have just gone back to the end of the line and let those who were PREPARED buy what they needed and get on, but you decided to hold up the process. I would have done the same

    thing to you, only I would have peeked outside to watch.

  3. you can be mad all you want. but is there a need to make a legal deal over this. its a bag of rice. ya that may be very expensive for you , but i don't think you should do it. altough it may hold up like the stupid mcdonalds coffee thing. you never know. but do you really want to hold up court for some rice? this economny has better things to legalize in court then rice. but if you do have to sue someone then the lady.but remember you never know what se may be going through right now in life.

  6. You should not be suing anyone! Sounds like a completely frivolous lawsuit, and your sister makes me fear for the future of our (already so screwed up) legal system. You ought to be ashamed for even considering this, when there are people  who have really been seriously injured out there.

    First of all, you have no idea if the cashier even ripped the bag. Most likely, the bag was torn before you even picked it up off the shelf. You have no proof that the lady even tore it. If she did, the other customers in line probably would've noticed her doing it.

    Like many others have said already, get over yourself. You are wasting your time over something as stupid as this. If you weren't happy, all you had to do was go to the customer service booth and talk to them and/or a manager. I am sure they would let you replace your bag of precious rice. The bag was ripped inside of the store so it is their responsibility to replace it.

    You are handling the situation all wrong. I'm sure the judge will just throw the case out because it is so silly.

Hi I am struggling financially so I know how frustrating it is to buy something only to find out it's spoiled or like in your situation poured out of the bag.  It almost seems like a waste of money and if that was the last of it untill pay day then I can understand your anger.  I think (not to be mean) that you may be overreacting a  bit.  If it had happened to me, I would've walked right back in and demanded another bag of rice same price and brand...if she saw it happen and it happened like in the last wk. or so just go back with your receipt and remind her of the incident.  If she doesn't comply then ask to speak to the store manager.  If the store manager isn't available keep asking her when he/she will return.  I'm sure they have the whole incident on video tape too so you wouldn't be lying or anything and maybe they will catch her doing something then they would be at loss for the bag of rice and  it would be of no cost to you except your money back. Maybe the cashier would end up being on employment probation.  I do  understand how you  could be so angry though.  Just take a deep breath and don't sweat over the small stuff.  Good luck.

  10. I think the person behind you and the store should both sue you for wasting thier time since you were unprepared to make a basic purchase.

    I don't think either of them have anything to worry about.  If you can't even make a basic purchase I would be very surprised of you could find the courthouse let alone make a case.

  12. First off, pay attention to your spelling. Second off, you should of went back to the store for another one. Did you try? Unless you tried to make ammends with the opened bag of rice, which you didn't, you are at fault. The store doesn't even know about this.

    I'm sure it was a customer behind you that did that. Why would the cashier want a mess made at her counter?

    Rice is cheap, and you should of paid attention to the price and what is in your wallet. Obviously, you didn't, otherwise you would of known if you had enough money.

    They should sue you for being arrogant.

  15. No offence intended but is this a serious question? A bag of rice is what... $10? Your going to take somebody to court over a hole in a bag of rice?? If i were you I'd save my time and energy, get over it and shop at a different store.

  16. wow your sister studding to be a lawyer i hope she studies really hard after that advice she gave you. you should not sue anyone first because you cant prove that the girl cut the bag second because you wasted what 5 dollars on some rice what are you going to sue for? how much money? the cost of your clothes? no no no you should just get over this you cant prove anything and there is no case here

    because people sue so often that companies have to make rules to protect themselves, so nobody can do anything anymore for fear of getting sued.

    Next time just bring enough cash :P

  18. Just go back to the store and tell them the bag was ripped before you got it out of the store and exchange it for an unopened one.  Be demanding and talk to the manager.  I think they will resolve it, no questions asked.
