Should i dodge the FEDEX delivery that wants to deliver me a CC civil lawsuit???

3 days ago i answered my phone it was a creditor that i owe $1600, I told her i would be filing for bankruptcy next week. She said oh i gotta send out a letter to you. Do you think it is a civil lawsuit? If i dodge the summons can they still sue me?

I owe 15 other creditors (total debt of $20,000) so no point in paying this one as i will still owe 14 others. Should i just sign for the letter delivered & face it & file for bankruptcy or dodge the letter?

as this is the only creditor that seems to want to come after me.

  1. Just take the letter - it'll catch up with you eventually anyway.

    And speak to a lawyer about filing the BK. Good luck.


  2. To dodge or not to dodge. You can run but you can't hide from the law man. They must make reasonable effort to serve you with the summons. If you don't take it and/or acknowledge it but they have proof that it was sent to you. Fedex has tracking #'s so they'll just leave it in your mailbox/door and they'll be in the clear.

    In the meantime you're still getting sued.


  3. If your filing bankruptcy, take the letter (sign for it). You're going to have to disclose this debt to your attorney. Present the summons or letter to your attorney and see what he or she suggests for dealing with this collector.

  4. You can accept it even if they are going to sue you,you can still file bankruptcy.It doesn't matter if you get served.
