Question:

Should i still be working?????

for the past 4 months i have been working in a pub (i stated working there the day the landlady *mary* took over) now mary is leaving and the new landlady *sandra* (who i have never met!) takes over next week. i have been told from mary that the new landlady has got her own staff and therefore i wont be needed.

i have been doing 17hours per week, 5 nights a week, on the books, for the past four months. what rights do i have to keep my job?????

  1. ohmigosh im not sure if you have rights, but if not, you should. im thought that in order to be fired, you have to go through a long thing, they cant just sack you, they have to have valid reasons and stuff. not just because she has her own staff. i could be wrong. but that's what i've been told. you cant just be replaced, you should AT LEAST get redundancy money, but even then thats not right as you aren't being made redundant, just being replaced. im pretty sure they can't do that.

  3. yOU MAY NOT HAVE ANY RIGHTS BUT IF YOU NEVER MET THE NEW LANDLADY TRY MAKING A GOOD IMPRESSION SO SHE WOULD SEE THAT UR A DECENT INDIVIDUAL THATS CAPABLE OF GETTING A JOB WELL DONE AND WHO KNOWS SHE JUST MAY KEEP YA AROUND

  4. Unfortunately no rights, but you can ask the new owner to keep you because they will never regret it.

  5. what's right - imagine sandra is ok and you work with 'sandra', but you do not fit with her staff .. what next - you're in trouble. It's much better if you quit nicely and find another job and with your 'good repotation' it's easy for you to get a job you like most.

  6. Unfortunately, when a restaurant is being sold to a new owner, it is up to the new person in charge to decide who remains on the job and who leaves. In this situation, the new owner is bringing in new staff with her. If this was a unionized job or a government job, they couldn't terminate you (especially under a union contract) unless you were being fired for doing something that was illegal or unethical. The only way Sandra, the new one in charge,  would have to keep you there is if you were working under contract and it stated things in it that extended to the new one who is in charge. But, from the way it sounds I do not think there is any contract or union involved. If I were you, I would move forward and start applying for another job. However, if you really want to continue working where you are, you could ask Sandra if she needs additional workers, and leave your resume and contact information with her. Don't be surprised if she is bringing in a new staff and doesn't wish to keep any of the former help from the other owner. When you apply for another job, maybe you could use Mary as your work reference. Good luck!

  7. You have the right to keep your job... BUT... they have to right to hire a whole new staff... When you sell a restaurant you dont sell the crew that works for you with it.. you sell the property itself. understand?.....im sure if you talked to *sandra* about keeping your job she may consider but she doesnt have to keep you. Just be careful... If i were you i would start looking for a new job Just in case.....because its not up to you its up to *sandra* and that sucks but... what can you do right?!!!  Good luck!
