Should i take the time to sue the nissan dealership?

i bought a nisan sentra se-r about 3 weeks ago and i was driving down the interstate and the front left wheel came off and i wrecked into the center median!luckally i was the only one involved in the accident!the air bags didnt deploy and the tires and rims are from nissan,so should i do it,is it worth my time?

  1. Hmmmm, new car? Used Car?

    Insurance involved?

    Do any damage to the road? the curb? a pole? If so you are obliged to report it to Police.

    Talk to the dealer and see what happens...........

    Get some advice from a lawyer?

    New.......let them take care of everything, its under warranty....

    Used.....talk with them but used cars are 99 percent of the time sold "AS-IS".........unless otherwise stated.

  3. I will have to agree with UCANTCME on this one. it depends on what your waranty and your contract says. If you are not sure, you may have to contact a blood sucking lawyer to get legal advise. just make sure the lawyer doesn't say "lets sue em" right off the bat or they are just in it for your money.

  4. If you bought it from a dealership, they usually make you sign something that says you agreed to buy the car "as is".

    If you bought it "as is" then you pretty much have no case. From the moment you took ownership of the car, you are responsible for it. Including making sure the wheels are properly secured. If you had actually caused property damage or damage to another car, you would be liable (unless you can prove that it was caused by a vehicle design flaw and not due to poor maintenance).

    However, some states do not allow "as is" sales of used cars. And they enforce an "implied" warranty to force sellers to meet reasonable quality standards.

    For example, if the wheel fell off due to extensive rust damage or damage from a previous accident that was not properly repaired, then you might have a case.

  5. how do you know that nissan or the dealer is at fault?

    someone else couldn't have tried to steal a wheel and tire and got scared off before completing the task?

  6. Honestly, I don't think you have a case.  

    It's up to the driver to check to see if the tires on are correctly.  You can't assume anything.

    The dealer is not responsible for driver negligence.

    If it were this easy to sue a dealer, everyone would loosen their lug nuts and drive until the tire fell off.

  8. Hi, You did not say weather the wheel came off just after leaving the place where you bought it! I that's the case the car should have been checked though out including the tyres & wheels & most important the wheel nuts & Their torque settings check your paper work, and check what (IF) they have checked these then check with you local tyre fitters the Torque Settings of the other wheels
