Should my mom sue her doctor?

My mom has this Phy. D. About 4 months ago my mom had swollen glands and the doc told her it was the mumps, because they were swollen for about a week. Turns out it was just a miner infection and NOT the mumps. Then 3 months ago my mom starts having breathing problems. She quit smoking last Sept. She went to the doc and she told my mom she had emphysema. 2 weeks ago we find out it was only asthma. Should we sue for malpractice?

  1. Sue doc for wrong misinformation ...well you won't get anywhere, because you paid him for his 'opinion' and that's what you got. You need to get another doctor since this one gave to diagnosis wrong..boy, I would


  2.   since your mother had symptoms that any reasonable doctor could mistake for mumps and for emphysema ( especially with a history of smoking )..this would not be a good case for a malpractice claim....malpactice reguires that the doctor was sooooo far off base in what he did that a majority of other doctors would not have done what he did in treating the patient..... you don't have a case fitting that situation.

    It’s BS lawsuits like this that causes huge increases in malpractice insurance, which means fewer doctors to go around and higher medical costs for all of us. You sue only in extreme cases of gross negligence that caused you serious harm.  You don’t sue over little mistakes that didn’t hurt you.

    I had a doctor tell me my migraines were sinus headaches from allergies. I got a new doctor and a proper diagnosis.

    My dad went to the doctor and was diagnosed with bronchitis. When that didn’t get better after a month, he was referred to a specialist who diagnosed him with congestive heart failure & emphysema . Do you see us suing the first doctor for getting it wrong? NO, of course not.


  5. as long as  your mom didnt get hurt cuz of the docs mistake,,,then i dont think you can sue for that...but i would sure report him to the board of medicine.

  6. I am glad your mother quit smoking and she is trying to take better care of herself. But she needs to get another doctor. Either his is over worked or he is inexperience. Thank goodness she doesn't have a real fatal illness and he overlooked it. He misdiagnosed her which didn't cause her much harm. However I would look into it with an attorney and see what happens.  

  7. Your mother brought on whatever diseases she has. SHE SMOKED and everyone knows the dangers of smoking. Whatever she is suffering from in HER FAULT and not the doctors whether or not he misdiagnosed her problem[s]. Everyone is so quick to blame someone else for their own shortcomings.

  9. A misdiagnosis which didn't cause your mother any physical harm should not be considered malpractice.

  10. Studies show that most people who sue over dumb stuff are broke.  It sounds like you are broke and looking in every nook and cranny for a get rich quick scheme

  11. i dont think you should sue the doctor, maybe just get a new doctor. everyone will say that people make mistakes even though it isnt fair for you.
