Should the 1st Amendment—specifically, freedom of expressive association—enable an organization like the Boy Scouts of America to discriminate whomever (e.g., members and leaders) it wishes?

  1. Since it is a private organization, the First Amendment wouldn't apply to it. However, it should prevent any government organization from providing them with aid if they do discriminate.


  2. *Private* organizations have the right to allow or reject any one they choose to within the confines of the law.  For example, the NAACP could decide to prevent all non-blacks from joining.  Private, women-only universities prevent men from enrolling.  Closer to home, gyms that are geared for women successfully prevent men from joining.

    The 1st Amendment was written to prevent the Federal government from *establishing* an "American Religion", controlling the press, preventing anti-governmental speech and preventing the citizenry from assembling to protest.  All these activities had taken place or were prevented from occurring (as the case might be) by the Crown.
